The sale of products on the site of www.giudioro.it and ‘governed by these “general conditions of sale” divided into the following articles.
1 THE PARTIES
1.1 Giudi Oro s.r.l., with registered office in Via Francesco Baracca 51, 52100 Arezzo Italy, hereinafter referred to as the “Seller”, carries out its activity of electronic commerce through the online sales site www.giudioro.it, hereinafter referred to as e-commerce, and addresses itself directly to the “Final Consumer” or to subjects with a regularly active VAT number.
1.2 “End Consumer”: any natural person who has reached the age of majority, has the legal capacity to enter into contracts, who purchases goods from the above site for non-commercial purposes.
If the end consumer is a minor (not legally able to enter into a contract), a parent or legal guardian shall be responsible for placing the order and accepting these terms and conditions of sale.
1.3 The Seller may make changes or amendments to these “General Conditions of Sale” at any time. Therefore, the customer will be required to accept the “General Conditions of Sale” at the time of purchase.
1.4 The final consumer, hereinafter referred to as the “Client”, is requested to carefully read the “General Conditions of Sale” accessible through the links on www.giudioro.it and the email he will receive after the “order confirmation” following the purchase procedure.
1.5 Whoever intends to use this e-commerce will be held, by virtue of the use made, has agreed to be bound by the Privacy of the seller that is an integral part of these Conditions of Sale
2 PRODUCT SHEETS
2.1 Product Sheet: each product is represented by a photograph and is accompanied by a “Product Sheet” containing:
(a) General description.
b) Measure and approximate weight
c) Price. The price indicated in the product sheet and in the “catalog”, is the sale price to the public including VAT, excluding transport costs, charges and customs duties related to the Customer’s country of origin and/or destination of the goods. Giudi Oro s.r.l. reserves the right to change prices at any time and without notice. The Customer will be charged the prices present at the time of the “Order Confirmation”.
d)Photos: although the photos are taken with care, it is possible that the photograph does not faithfully represent the product. Consequently, Giudi Oro s.r.l. will not be responsible for any inadequacy of the graphic representations of the products shown on e-commerce. The photo is to be considered only as an example.
3 PROCEDURE FOR MAKING A PURCHASE
3.1 When you decide to make a purchase, the customer must register their data, with the inclusion of a password protection that you are required to keep confidential. In the case of registered users, access to their account will take place by entering their registration data.
3.2 Product selection and cart construction: product selection is done by clicking on the “Add to Cart” button. The “Shopping Cart” can contain one or more products and can be modified at any time before the “Order Confirmation”. The addition to the cart can be done either from the catalog or subsequently from the product sheet.
3.3 Order Confirmation: The confirmation of the order may take place after the acceptance of the “General Conditions of Sale” and the inclusion of information that are essential for the acceptance and shipment of goods listed in the “Order Confirmation”, ie the list of products in the cart including shipping costs. It is recommended that the Customer print a copy of these Conditions of Sale. The Customer must ensure that all personal information entered is correct and true.
3.4 Methods of payment: the customer can choose one of the following methods of payment on e-commerce:
– Bank transfer: in case of selection of bank transfer the Customer shall make a transfer to the bank coordinates found within e-commerce. The proof of payment is given by the crediting of the amount of the transfer on the Seller’s current account.
3.5 Acceptance of the order: the Seller reserves the right to refuse the order, if the Customer has not respected the purchase procedure, has not accepted the General Conditions of Sale or if he does not provide all the data required for shipping and billing or in any case if the payment is not successful, or in case of selection of bank transfer, the amount is not charged within five (5) working days from the date of transmission of the order confirmation on the Seller’s bank account.
The total amount includes the sum of the selling prices and any transport costs, depending on the delivery method selected by the customer, and / or present on e-commerce. Any customs clearance charges and taxes relative to the country of shipment are excluded.
3.6 Acceptance of the order: the Customer accepts his order by sending the Order Confirmation, as per article 3.3, to the Seller electronically.
The Order Confirmation is proof of acceptance of the order by the Customer, including these General Conditions of Sale.
3.7The Order Confirmation will be archived in our data bank for the period of time necessary to the evasion of the orders and however in the terms of law.
3.8The language available to conclude the contract with the seller is Italian.
4 TAKING CHARGE OF THE ORDER AND AVAILABILITY OF PRODUCTS
4.1 Once the contract is concluded, Giudi Oro s.r.l. will take charge of your purchase order.
4.2 Product availability: if the products presented on e-commerce are no longer available or on sale at the time of the last access to e-commerce or at the time the order confirmation is sent, the Seller will promptly inform you of the possible unavailability of the ordered products. In case of forwarding the order confirmation and payment of the price, the Seller will refund what has already been anticipated by the Customer.
4.3 With the transmission of the Order Confirmation the Client declares to know and accept the General Conditions of Sale and the further information contained in www.giudioro.it.
4.4 At the end of the contract, the Seller will send to the Customer by e-mail, a receipt of the purchase order.
5 RIGHT OF WITHDRAWAL
5.1 The Customer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased on e-commerce. It is not possible to change a product with another one. Except in cases where the Seller deems to accept the change by the customer.
5.2 The Customer can withdraw from the contract by means of a written communication sent by registered mail to Giudi Oro s.r.l., Via Francesco Baracca 51, 52100 Arezzo within 14 days from the receipt of the goods.
In order to simplify the return procedure, the communication can also be sent by simple e-mail to firstname.lastname@example.org within 14 days from the receipt of the goods.
The seller will send a confirmation of receipt of the request for withdrawal by e-mail with all the instructions to proceed.
The customer must return the goods within 14 days from the date of the communication of the return (email or registered mail). The deadline is met if the customer will deliver the goods to the shipper before the expiry of the period of 14 days. However, we recommend the customer to contact us at email@example.com to facilitate the refund procedure. The refund will be made by bank transfer as soon as possible and in any case no later than 14 days from receipt of the registered letter or e-mail that communicates the desire to withdraw from the purchase, but not before the return of the product purchased that must be in the same condition in which and ‘was sent. If there is no correspondence between the recipient of the products indicated in the order form and who made the payment of sums due for their purchase, the refund of sums, in case of exercise of the right of withdrawal, will be performed by the Seller, in any case, against those who made the payment. The consumer has the right to withdraw without any penalty, the only costs to be borne by him are those related to shipping for the return of the product, the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer. Giudi Oro s.r.l. is not responsible in any way for theft/loss of goods returned by uninsured shipments. The goods subject to exercise of the right of withdrawal must be returned in a normal state of preservation, as it has been kept and possibly used with the use of normal diligence. If the procedures and terms for exercising the right of withdrawal, as specified in this paragraph, are not respected, the Customer will not be entitled to a refund of the sums already paid to the Seller or to the issuance of the requested credit; however, the Customer, at his own expense, may re-obtain the products in the state in which they were returned to the Seller.
6.1 Generally, delivery in Italy takes place within seven (7) working days from payment and within ten (10) days outside Italy. Except for unforeseen events and customs clearance times. The Seller, however, is not responsible for actual delivery times different from those indicated even if it will take all necessary actions to respect them.
7 LEGAL GUARANTEE OF CONFORMITY
7.1 All products marketed by Giudi Oro s.r.l. are covered by a 24-month warranty for conformity defects. In order to take advantage of the warranty assistance, the Customer must keep the invoice/receipt (or the delivery note) he will receive together with the purchased goods. The legal guarantee of two years from the date of delivery of the goods must be claimed by the consumer within two months from the discovery of the defect.
7.2 The guarantee of 24 months applies to the product that presents a lack of conformity, provided that the same is used correctly, in respect of its intended use. This guarantee, is reserved only to the private consumer (a person who buys goods for purposes not related to his professional activity, or makes the purchase without indicating in the order form a reference to VAT). In case of lack of conformity, Giudi Oro s.r.l. will provide, without cost to the Customer, the restoration of conformity of the product by repair / replacement or reduction of the price, until the termination of the contract. If, as a result of the seller’s intervention, a conformity defect should not result, the Customer will be charged for any costs of verification, restoration and transport costs if incurred by the seller.
7.3 In the hypothesis in which, for any reason, the vendor is not able to repair a product under warranty, he will proceed, with the consent of the Customer, to the substitution of the product itself (if still in the price list) or with another of equal characteristics and value.
7.4 No damage can be requested from Giudi Oro s.r.l. for any delays in carrying out repairs or replacements of products under warranty.
8.1 The sale contract between the Customer and the Seller is concluded in Italy and regulated by the Italian Law. For the solution of civil and penal controversies deriving from the conclusion of this contract of sale at a distance, if the Customer is a final consumer, the territorial competence is that of the reference forum of his town of residence or domicile; in all the other cases, the territorial competence is exclusively that of the Court of Arezzo.
8.2 The Customer can make use of the procedure of Joint Conciliation (Art 49 paragraph 1 letter V of Legislative Decree September 6, 2005 n.206 Consumer Code), if after having complained to the seller has not, within 45 days, received an answer or has received an answer not considered satisfactory.
8.3 Pursuant to art. 14 of Regulation 524/2013 the user in case of dispute may file a complaint through the ODR platform of the European Union (out-of-court settlement of disputes arising from contracts of sale or online services).
